Terms & Conditions

1. Who you are contracting with

The Ethereal Bodylabs service (the "Service") is operated by Ethereal Material Pty Ltd(trading as "Ethereal Bodylabs"), a company registered in Australia ("we", "us", "our"). By creating an account or otherwise using the Service, you enter into a binding agreement with Ethereal Material Pty Ltd.

2. Acceptance of these terms

By accessing or continuing to use the Service you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the Service. You confirm you are of legal age in your jurisdiction and, if using the Service on behalf of an organisation, that you have authority to bind that organisation.

3. The Service

Ethereal Bodylabs provides fitness, physique, nutrition, dosing log, and AI-assisted coaching features. The Service is a self-tracking and educational tool. It is not medical advice, diagnosis, or treatment, and does not endorse the use of any medication, hormone, peptide, or supplement except under the supervision of your licensed physician.

4. Account and acceptable use

You must provide accurate information, keep your credentials confidential, and are responsible for all activity under your account. You agree not to:

  • use the Service unlawfully or in breach of any applicable regulation;
  • commit fraud, spam, or abuse of other users or third parties;
  • infringe any intellectual-property or privacy right;
  • interfere with the security or integrity of the Service, including probing, scanning, reverse engineering, deploying malware, or circumventing access or rate limits;
  • resell, redistribute, or grant third-party access to the Service without our written consent.

5. Intellectual property

The Service, including all software, models, content, branding, and documentation, is and remains the property of Ethereal Material Pty Ltd or its licensors. You are granted a limited, non-exclusive, non-transferable right to use the Service in accordance with the plan you have subscribed to. Your own content (photos, logs, notes) remains yours; you grant us a limited licence to host and process it solely to operate the Service.

6. Payment and subscriptions

Web billing is processed by RevenueCat (via Stripe). In-app purchases on iOS are processed by Apple through the App Store. Payment, billing, tax collection, cancellation, and refund mechanics are governed by the applicable platform's terms in addition to these Terms.

Subscriptions renew automatically at the end of each billing cycle unless cancelled beforehand. You can manage or cancel a subscription at any time from the in-app billing page, or (for iOS purchases) from your Apple ID subscription settings.

7. Free trial

New Premium subscribers receive a 30-day free trial. Unless cancelled before the trial ends, the subscription automatically converts to a paid Premium plan and your payment method will be charged the then-current price.

8. AI features and coaching

AI-generated outputs (plans, coaching, technique cues, meal or dosing suggestions) may be inaccurate or incomplete and must not be relied on as professional medical, nutritional, or legal advice. You are responsible for your own prompts, for verifying outputs, and for having the rights to any content you submit. We may filter, refuse, or remove outputs and restrict accounts that repeatedly misuse the Service.

9. Service level and warranties

The Service is provided "as is". To the fullest extent permitted by law we disclaim all implied warranties including merchantability and fitness for a particular purpose, and make no guarantee that the Service will be uninterrupted, error-free, or continuously available.

10. Liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profit, data, or goodwill. Nothing in these Terms excludes liability that cannot lawfully be excluded.

11. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination your right to use the Service ends; you may request an export of your data for a reasonable window before deletion.

12. Changes

We may update these Terms from time to time. Material changes will be notified in-app or by email.

13. Governing law

These Terms are governed by the laws of New South Wales, Australia, and the courts of that jurisdiction have exclusive jurisdiction over any dispute.
